Lake Concessionaire to Hold Grand Openings on June 20
The new concessionaire for Monterey County’s South County Lakes will
hold grand openings on Friday, June 20, for Lake San Antonio Resort
& Marina and Lake Nacimiento Resort & Marina.
The event will be hosted by Monterey Lakes Resorts & Marinas, a Forever Resort.
The festivities at Lake San Antonio will be from 10 a.m. to 2 p.m. with concurrent events at
Lake Nacimiento from noon to 3 p.m.

Do Vacation and Second Homes Qualify
for IRC §1031 Treatment?
It has been established that vacation or second homes held by the
Exchangerprimarily for personal use do not qualify for tax eferred
exchange treatment under IRC §1031. There has been no clear direction
when a second home has mixed use, what roportion of rental versus
personal use would qualify the property as held in a trade or business.
Neither has there been clear direction hen a second home qualifies as
held for investment. In Moore v. Commissioner, T.C. memo 2007-134, the
Tax Court held that properties held for personal use with the mere hope
or expectation of gain did not establish investment intent.

Update on Quagga Mussel Issue
The Monterey County Water Resources Agency will be conducting mussel training
at the MCWRA office in late May for the government agencies who will be
coordinating the Mussel Prevention Program. The training session will
be conducted by the CDFG for Monterey and San Luis Obispo County staff
that will involved with the Quagga issue.
Along
with training, this will be a good opportunity to get a roundtable
discussion of how to deal with combating the mussel problem in both
reservoirs in the future.
Monterey
County Parks Department is passing out a mussel flyer from the CDFG to
boaters coming into San Antonio and Nacimiento lakes, and game wardens
from Fish and Game will be conducting public outreach on the mussel
issue on May 17 on both lakes.
In
addition, the MCWRA will be installing 3 ft. signs at all launch ramps
in the next few weeks at both lakes for boaters to be aware of the
mussel issue.

Nacimiento Dam Spillway Construction Begins
Construction on the Nacimiento Dam Spillway Modification Component of the Salinas Valley Water Project began on Tuesday, April 1, 2008, and will continue during the non-rainy seasons over the next two years.
Because of construction activities, there will be periods when traffic on Nacimiento Lake Road will be affected by construction truck traffic, and there will be variations in the levels of Lake Nacimiento. However, the construction schedules and the water levels will not have significant effects on traffic around the reservoir and on recreational activities, particularly on weekends and holidays.
The purpose of the Nacimiento Dam Spillway Modification Component, which includes enlargement of the spillway and installation of a rubber spillway gate at the dam, is to address safety issues associated with the flood flows that must be conveyed through the reservoir and the spillway.
State and federal regulators require that the dam be modified so that if a large flood event were to occur, the dam's spillway could release enough water to ensure flood protection and safety of the dam. In addition, the spillway modification would provide additional water releases during the year for water conservation in the Salinas Valley. Dam safety and the protection of lives and property is the mission of both agencies and the Monterey County Water Resources Agency (MCWRA). Without this project, the MCWRA would have to provide an additional flood storage equal to 17 feet of elevation by lowering the reservoir level as of January 1 every year to 765 feet.
"The Agency's goal has been to stop seawater intrusion and to increase flood protection at the dam. This project allows us to meet that goal," according to Curtis Weeks, general manager of the Water Resources Agency.
The SVWP, approved by an overwhelming 85 percent of property valuation in the Salinas River Basin in 2003, is intended to help stop seawater intrusion, improved flood control and Nacimiento Dam safety, recharge of aquifers and improved river flow for migration of the federally designated threatened Steelhead trout.
Modifications to the spillway at Nacimiento Dam are expected to be completed by Fall 2009. Until then, construction will occur between April and September 30, 2008, and April 2009 to September 2009.
The second component of the Salinas Valley Water Project is construction of a diversion facility, which is another rubber dam on the Salinas River near Marina, to allow diversion of river water during dry times for treatment and piping to nearby farms for irrigation.

The Lake Nacimiento Water Project Presentation Night on February 26 hosted by Grace Borzini of Oak Shores Realty had a standing room only crowd. Presentations were given by Rob Johnson of the Monterey County Water Resources Agency, John Hollenbeck of the SLO Public Works on the San Luis Obispo Pipeline Project, and Phil Humfrey, Co-Chair Nacitone Watershed Steering Committee on the Nacitone Community Watershed Project. General feedback was that everybody left with a much better understanding of the projects, and many rumors were laid to rest. Synopsis of Lake Water Projects
San Luis Obispo County has began construction on the pipeline project that will draw over 15,000 acre feet a year from Lake Naci. (This will be a drop in the bucket compared to the normal releases that Monterey County takes annually.)
Monterey County Water Resources recently had it's ground breaking ceremony for the Lake Nacimiento Water Spillway project that will actually start construction in April. They have just awarded the contract to Granite Construction.
Regarding reservoir levels, the county is required by the Federal Energy Regulatory Commission (FERC) and the State's Department of Water Resources, Division of Safety of Dams (DSOD) to maintain a maximum reservoir (lake) level of 770 feet during the first construction season (summer 2008) and 764 feet during the second in 2009 (the maximum reservoir elevation at the Spillway is 800 feet). This is dependent upon the amount of rainfall and inflow received by the reservoir. They estimate the construction schedule to cover two construction seasons from April 1, 2008 to September 30th, 2008, then the same period in 2009, with final completion by Sept 30th, 2009. They will be finalizing a final construction schedule with the contractor in the coming weeks, which will hopefully shorten the seasons and provide some cost-savings.
Their goal is to maximize reservoir elevations during construction while in compliance with the regulatory agencies and in consideration of workers' safety while completing modifications in the Spillway Chute structure itself. This will maximize recreational benefits and water conservation goals. As noted, we will be providing project updates throughout the construction. The Fireman's Ball on March 15th was a huge success!!!
Cindy Peyton and her crew prepared and served 93 attendees a gourmet meal of Chicken Picata or stuffed flank steak with rice pilaf, roasted vegetables and chocolate cake with raspberry sauce for dessert. The evening brought in over $2,000.00 worth of donations for our Oak Shores Fire Department.
Great music by D.J. Jim Lovato. Lots of great community volunteers worked hard to make this event happen.

Fort Hunter Liggett won't house active Army brigade
Army decides to relocate units to other posts in troop increase

Fort Hunter Liggett in southern Monterey County is out of the running as an active Army brigade base.
The Army on Wednesday announced 19 decisions involving stationing troops to meet President Bush's plan to increase Army troop strength by 74,200 soldiers, including the stationing of six new infantry brigade combat teams, eight support brigades and other smaller combat support units.
Fort Hunter Liggett had been considered as a possible site for such a brigade, but the Army has decided to station the new brigades at other posts, according to Army spokesman Maj. Thomas McCuin at the Pentagon.
The Army will relocate the 1st Armored Division from Germany to Fort Bliss, Texas, and the 1st Infantry Division from Germany to Fort Riley, Kan., and Fort Knox, Ky., by September 2011.

The Army currently has 42 active brigade combat teams, which will increase to 48 such teams stationed at Fort Carson, Colo., Fort Bliss, Fort Stewart, Ga., and White Sands Missile Range, N.M.
The Army will also activate eight support brigades and restation two others at Fort Hood, Texas; Schofield Barracks, Hawaii; Fort Leonard Wood, Mo.; Fort Bliss; Fort Richardson, Alaska; Fort Lewis, Wash.; Fort Polk, La.; and Fort Drum, N.Y.
The Army will also station approximately 30,000 soldiers in combat support and combat service support units throughout the United States as well as various overseas locations, McCuin said.
Combat training center Fort Hunter Liggett will become the first of four combat support training centers to teach combat skills to reserve soldiers during their three-week annual active duty obligation, including weapons training, familiarization and qualification firing. Others are planned at Fort Dix, N.J.; Fort McCoy, Wis.; and a site to be named.
Last month, the Army Reserve broke ground on a new headquarters building at Fort Hunter Liggett for the 91st Operations Group, which will operate the combat support training center.
