IN MEMORY OF DREW ENFIELD
Our heartfelt condolences go out to our full time residents and neighbors Todd and Terry Enfield whose 15 year old son Drew passed away this past week a few hours after being hospitalized for what the family thought was flu. He ended up having an extremely rare type of Leukemia.
The service for Drew will be this Saturday May 22nd at 1 p.m. at the Oak Shores clubhouse. Janice Gillenwater is spear heading an effort to organize the food for the reception after the celebration of Drew’s life.
It would be greatly appreciated if you could send food to Janice or a donation for her to purchase food. Any extra money will go towards a memorial plaque and park bench for us to place in the Enfield’s front yard. Her number is 805-472-9404. Any help for the family would be appreciated. Thank you.

Recent winter rains have helped boost water levels at Nacimiento Lake, which had dropped to severe lows after three years of drought.
Earlier this week, the lake was at 44 percent of its capacity, compared with 27 percent about a year ago.

The next photo, taken last Sunday at the same spot, reveals docks once again floating and nooks of the lake refilling with water.
Rain is next expected on Friday afternoon, as several storm systems are slated to move into Central California, according to John Lindsey, a local forecaster and media relations representative for Pacific Gas and Electric Co.
That storm is forecast to bring rain through Saturday morning, with between 0.25 and 0.75 inches expected to fall, he said.
A break will occur Saturday afternoon through Sunday afternoon, but another storm will bring rain Sunday night through Monday morning. Showers will linger through Tuesday.
This rain season has already been wetter than the previous three: As of Wednesday, San Luis Obispo had received 24.55 inches of rain, just over the yearly normal of 24.36 inches. The rain year runs from July 1 to June 30.

OAK SHORES HOUSE FIRE!
The home of Michael and Shawn Davis of 2628 lower Captains Walk burned down this morning, Friday 1.15.2010. Cal-Fire was notified of the blaze in Oak Shores this morning at about 2:30am. When crews arrived they found the home completely ablaze. It was a total loss. The fire was contained at about 5 this morning.
Luckily no one was home at time of fire and fire fighters were able to save the surrounding homes with extremely minimal damage. The cause is unknown.
ISSUE WITH AIR VENTS
We are starting to have problems with air vents on houses being completely filled with acorns, leaves and other debris. This is a real danger and can lead to severe problems in your home. We just had an instance where a very well maintained two story house had the vents filled with debris all the way from ground level to the top. From drought to deluge, Lake Nacimiento relies on rain
Where there once was deep, shimmering water, Lake Nacimiento’s expansive stretches of dry sand and gravel started making people nervous in the past few months. Before the heavy rainstorm of Oct. 13 and 14, the reservoir was officially considered more than 90 percent empty, even as construction proceeded on the new pipeline designed to carry Nacimiento water to household faucets all over SLO County.
The dragon-shaped lake whose very name means “birth” in Spanish was reborn—at least a little—thanks to the unseasonal deluge. Records from Monterey County show the official lake level rose by more than 20 feet, increasing from 9 percent to 19 percent full overnight.
Monterey County owns the dam it built in the rugged watershed northwest of Paso Robles more than 50 years ago, and it also owns nearly 95 percent of the water Lake Nacimiento contains when full. That water is released from a pipe near the bottom of the dam nearly every day, flowing into the Salinas River where it recharges groundwater in the agricultural valley. SLO County is entitled to 5 percent of the lake’s capacity, or 17,500 acre-feet.
If it hadn’t started raining, Monterey County would have had to stop releasing the lake’s water on Oct. 20 to save what was left for SLO County, according to Courtney Howard, a water engineer with SLO County’s Public Works Department.
Although members of SLO County’s Water Resources Advisory Committee—and lakeshore homeowners—were becoming concerned about the low lake levels and continuing drought, Nacimiento Water Project Director John Hollenbeck said there was no real cause for alarm.
“There’s never been a year when Nacimiento Lake was almost empty and there was no rain. The reservoir is doing exactly as it was designed to do. It’s been dry—empty—five times, and it’s been brim full even more times,” Hollenbeck said.
San Luis Obispo and North County communities are planning to start using Nacimiento water as early as next summer as a “supplemental” source, according to Hollenbeck. The environmental impact statement for the project stated that the Nacimiento Water Project will “remove an obstacle to growth and lead to increased growth in San Luis Obispo County communities and cities.
”Private water companies around the county have also requested the water, according to the environmental report, and would then be able to “change land use to accommodate residential projects.
”Decision-makers in Cayucos have already eliminated the coastal community’s “water supply emergency,” and have started allocating their share of Nacimiento water to vacant parcels in the southern part of the town.

Nacimiento Water Project Ahead of Schedule
Construction work on the $176 million Nacimiento Water Project is ahead of schedule.
According to Nacimiento Project Manager John Hollenbeck, county officials and the project team originally estimated work to be complete in December 2010. Hollenbeck said the project would instead wrap up around July or August 2010.
Hollenbeck said that recognizing the unfortunate situation regarding two tragic accidents that caused the death of two construction workers, was pleased with the construction progress made so far on the project.
“That weighs heavily on everybody’s minds, mine, too, and it is an unfortunate thing,” he said of the accidents. “We have had some very disappointing things, the deaths of the men to date is hugely tragic; it’s a spirit killer. But this also points to this business being very dangerous.”
According to Hollenbeck, the schedule was not so tight that it would be unreachable but said officials laid out a timeline that was both fleible and reachable.
“I’m pleased with the pace things have been moving,” Hollenbeck said. “It’s ahead of schedule – that’s unusual – we managed to get this [project] at a time when folks were looking for jobs, and we got a good contract. In fact, we just completed the central portion and certified that. I’m happy that [the project] is on its way, now we just need some rain to fill up [Lake Nacimiento].
”Whitaker Contractors, Inc., the contractor on the Pipeline Central, earned an estimated $50,000 as part of an incentive provision included in its contract for finishing early, Hollenbeck said. Whether the four remaining “specs” of the project–including the intake, facilities and water storage tanks, Pipeline North and Pipeline South–will earn extra funds through the incentive program for finishing early is yet to be determined.
“Whitaker was extremely well organized and planned the job well, resulting in their completion ahead of schedule,” said Hollenbeck. “It is a great feeling as we start to see parts of this large project being completed.”
According to Hollenbeck, delivery of the Nacimiento water is expected as planned in mid-2010.
Hollenbeck said county officials are working with the participants to see when they would like water delivery. None of the project participants are mandated to have the water delivered at a certain time, he said. As the projects near completion, Hollenbeck officials would contact the participants to see when they want the delivery and how much water they would like delivered under their agreements. Hollenbeck said he recently sent out a request to Atascadero, which provided input indicating it would be taking its full 2,000 acre-feet of water over a period of four months beginning in June 2011, or roughly 500 acre-feet for four months. Hollenbeck said he hadn’t heard back from the other participants on when and how much water they wanted delivered as of press time.
Hollenbeck said the only thing on the critical path that would extend the project beyond the longest point would be delivery of the pumping equipment at the intake.
According to Hollenbeck, the project is within its $176 million with an estimated $132 expended thus far. Yes.
“My guess is it will come in under budget but I’m still too far out in time to know that,” Hollenbeck said.

BRYSON FIRE
On 8-26 there was a very large fire at the mouth to Bryson Hesperia and up New Pleyto Road. It was lucky that Tom and Melodie Shepard were home at the Planett Ranch along with a couple of contractors as they are credited for saving the homes and out structures on the 100 acres out of 2,200 acres of the Planett that did not burn. The fire burned mainly North East due to the prevailing winds and burned up into Hunter Liggett. It burned south as far as the Llama ranch. Below are pictures of the damage.
Area residents are very thankful that no homes were lost! Thank you to all of the neighbors and fireman who worked hard to stop the fire!

I now see a faint flicker of hope that Nacimiento Lake could escape being overrun with quagga or zebra mussels. But there’s still grave danger that an uninformed lake visitor might launch a boat contaminated with those tiny, foreign shellfish.
It could have happened over the Labor Day weekend.
Quaggas aren’t much bigger than a pat of butter, and zebras are even smaller. Both multiply like flu viruses. In one year, a single female can lay 1 million eggs. The eggs produce shellfish that attach like barnacles onto anything they touch.
They clot in layers on dock timbers and boats and inside pipes. At Hoover Dam on the Colorado River, quagga mussels in one year almost totally blocked all the four-inch gaps between the trash-rack gates that protect the powerhouse intake.
Experts estimate the annual nationwide cost of battling these mussels at$1 billion. If they invade Nacimiento Lake, they might clog the new $176 million Nacimiento pipeline.
Quagga and zebra mussels originated in Eastern Europe. They probably stowed away in the ballast water of seagoing freighters that visit the Great Lakes via the St. Lawrence Seaway. From the Great Lakes, the tiny invaders spread far and wide. Nobody has learned how to eradicate them.
They’re now on the move in California, within 200 miles of us to the south and within 100 miles to the north. Still, a news story from Salinas gives me hope.
The Monterey County Herald reported last week that Monterey County staff people are preparing a plan for defending Nacimiento and San Antonio lakes from the invasive shellfish. The plan would include inspecting boats being launched at each lake.
It will be complicated and expensive, especially at Nacimiento Lake, which belongs to Monterey County but is entirely in San Luis Obispo County. All San Antonio lakeshore property is owned by Monterey County, but most Nacimiento lakeshore property is privately owned.
Bill Phillips is deputy general manager of the Monterey County Water Resources Agency. He said his county controls all the San Antonio Lake launching points. But Nacimiento Lake has 60 launching points, of which his county controls only two.
Monterey and San Luis Obispo counties both have vital interests at Nacimiento Lake. Monterey County owns Nacimiento Dam and the hydroelectric plant below it, as well as the marina and campground. San Luis Obispo County is building the Nacimiento pipeline project.
Carolyn Berg, Nacimiento Project engineer, said the two counties plan a meeting next month to discuss the quagga/zebra threat. Phillips said the goal is to have a protection plan ready by next summer.

As of June 17 the lake was at 30% with the elevation at 738 feet, the water was at the 90 foot mark on the main ramp. The Monterey County Water Resources Agency reported release schedule has the lake level on July 1 at 736 feet of elevation and as of August 1 at 725 feet of elevation. Our main ramp will have to be closed at the 728 foot elevation. Based on this report we will have to close the main ramp about the third week of July. So, if you plan on using the lake, now is the time. We do have a single wide auxiliary ramp that can be used for a short period of time. The last time we had to use this ramp was in 1994. The Monterey County Water resources agencies sub-committee of the Release Committee will decide the release schedule in 2 weeks at their regular meeting. Then, it will go to vote by the board at the end of May. The releases are less than average for this time of year, according to Rob Johnson, as they are only releasing to obtain flow to Chualar. They normally release this time of year to gain flow to Spreckels, but they do not want to get that close to the project. February 2009 LOCAL LAKES GET ONLY A TRICKLE OF RAINFALL AS GROUND SOAKS UP ALL RECENT RAINFALL Storms barely budge county reservoirs’ levels; officials say the ground soaked up all the water. By David Sneed The Central Coast has received a series of drenching storms since the beginning of the month, but the moisture has added little to the area’s reservoirs. Water levels in the region’s six reservoirs are virtually the same as they were in late January. Of the six, Nacimiento Lake has risen the most, but that was only a 2 percentage point increase, from 27 percent to 29 percent of capacity. Water managers say the ground was too dry and the storms too far apart to create much runoff. Typically, 10 inches of rain has to fall, preferably in a relatively short period, before reservoirs react, said Bob Hamilton, water supply supervisor for San Luis Obispo. “We are primed, but we really haven’t made any progress,” he said. “It’s too early.” Only San Luis Obispo, Avila Beach and Santa Margarita have received more than 10 inches of rain this season. Paso Robles is the driest, with 3.78 inches of rain so far. As a result, three reservoirs in the county — Santa Margarita, Lopez and Whale Rock — have not risen at all. One reservoir, San Antonio, even went down a percentage point. Despite the dry conditions, few local communities are facing significant water shortages. Arroyo Grande, which gets its water from Lopez Lake and from wells, has instituted some water-saving rules. Other communities, such as San Luis Obispo, say they are still several dry years away from needing to enact water conservation measures, though the city regularly encourages residents to be careful with their water use. San Luis Obispo is one of the participants in the Nacimiento pipeline project, which is under construction, and this additional source will provide even more of a supply cushion when it comes available in 2010. Even managers of the area’s lowest reservoir, Nacimiento, say they are not worried. The lake stands at 29 percent as a result of the lack of rainfall and regular releases for aquifer recharge downstream during the summer, said Alex Hulanicki, a spokesman for the Monterey County Water Agency. The agency also manages the nearby Lake San Antonio, which acts as an upstream water reserve for Nacimiento. San Antonio is half full. “We are not perilously low in our water supplies,” Hulanicki said. “We have at least a full year of water supply to handle our needs.” While Nacimiento is in San Luis Obispo County, most of its water is owned and controlled by Monterey County. State officials said that California is facing the worst water shortage in its history. Most of the communities experiencing the greatest shortages get their water from three sources that happen to be in low supply, Hamilton said. These sources are the Colorado River, which is experiencing a severe drought; the Sacramento Delta, which is cutting back deliveries to protect a fish, the delta smelt; and Sierra Nevada snowpack, which is still at unusually low levels. DO VACATION AND SECOND HOMES QUALIFY FOR IRC 1031 TREATMENT?
It has been established that vacation or second homes held by the Exchanger primarily for personal use do not qualify for tax deferred exchange treatment under IRC 1031. There has been no clear direction when a second home has mixed use, what proportion of rental versus personal use would qualify the property as held in a trade or business. Neither has there been clear direction when a second home qualifies as held for investment. In Moore v. Commissioner, T.C. memo 2007-134, the Tax Court held that properties held for personal use with the mere hope or expectation of gain did not establish investment intent.

UPDATE ON QUAGGA MUSSELL ISSUE
The Monterey County Water Resources Agency will be conducting mussel training at the MCWRA office in late May for the government agencies who will be coordinating the Mussel Prevention Program. The training session will be conducted by the CDFG for Monterey and San Luis Obispo County staff that will involved with the Quagga issue.
Along with training, this will be a good opportunity to get a roundtable discussion of how to deal with combating the mussel problem in both reservoirs in the future.
